End User License Agreement (EULA)
This End User License Agreement (“Agreement”) is between you, the user, and Playcus Limited (“Company”, “we”, “us”, “our”). By downloading, installing, or using our games (“Game”), you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
1. License Grant
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Game solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
2. License Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Game or make the Game available to any third party.
- Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Game.
- Remove, alter, or obscure any proprietary notice (including copyright and trademark notices) of ours or our licensors’ contained in the Game.
3. Intellectual Property Rights
All rights, title, and interest in and to the Game, including all copyrights, trademarks, patents, trade secrets, and any other proprietary rights, remain with us or our licensors. This Agreement does not grant you any rights to trademarks or service marks of Playcus Limited.
4. Your Content
You retain all rights in any content you upload or submit to the Game. However, by uploading or submitting the content, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose.
5. Updates and Modifications
We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Game or any service to which it connects, with or without notice and without liability to you.
6. Disclaimer of Warranties
You agree that the Game is provided on an “AS IS” and “AS AVAILABLE” basis and that your use of the Game is at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
7. Limitation of Liability
Under no circumstances shall we be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Game, whether or not the damages were foreseeable and whether or not we were advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless [Your Company Name] and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorneys’ fees, arising from or relating to your use or misuse of the Game or your breach of this Agreement.
9. Term and Termination
This Agreement shall remain in effect until terminated by you or us. We may, in our sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
10. Governing Law
This Agreement will be governed by and construed in accordance with the laws of Republic of Cyprus, without giving effect to any choice or conflict of law provision or rule.
11. Severability
If any provision or part of a provision of this Agreement is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
